Welcome to kilovareni's educational platform. These terms govern your access to and use of our budget negotiation learning services. By accessing our website or enrolling in our programs, you acknowledge that you've read and agree to these terms.

We've written this in plain language because legal documents shouldn't require a law degree to understand. If something's unclear, reach out – we're here to help.

1. Acceptance and Scope

These terms create a binding agreement between you and kilovareni (ABN registered in Australia). They apply to all users – whether you're browsing our site, participating in free resources, or enrolled in paid programs.

We update these terms occasionally. When we do, we'll post the new version with an updated date at the top. Material changes will be communicated via email to registered users at least 14 days before taking effect.

Important: Continued use of our services after changes take effect means you accept the updated terms. If you disagree with changes, you may discontinue use and request a refund for unused portions of paid programs within 30 days of the change notice.

2. Educational Services and Program Access

Program Enrollment

Our learning programs begin in autumn 2025 and run throughout 2026. Enrollment requires creating an account with accurate information. You're responsible for maintaining the confidentiality of your login credentials.

  • One account per person – sharing login details violates these terms
  • You must be at least 18 years old or have guardian consent to enroll
  • Business enrollments may cover multiple team members under separate licensing agreements
  • Access credentials remain active for the program duration plus 90 days for review purposes

Content Delivery and Access

We provide educational content through our online platform, including video lessons, written materials, interactive exercises, and live workshop sessions. Program schedules are published in advance, though specific session times may adjust with reasonable notice.

Technical requirements: stable internet connection, modern web browser, and ability to participate in video conferencing. We're not responsible for access issues caused by your equipment or internet service, though we'll work with you to find solutions where possible.

Content Usage Rights

You may access course materials for personal learning and professional development. This includes:

  • Downloading materials for offline study during your enrollment period
  • Taking notes and creating personal summaries of lessons
  • Applying techniques and frameworks learned in your professional work
  • Discussing concepts with peers in your organization

You may not reproduce, redistribute, or commercially exploit our materials. Recording live sessions without permission, sharing login credentials, or posting course content publicly all breach these terms.

3. User Responsibilities and Conduct

Learning works best in a respectful environment. We expect participants to engage professionally during interactive sessions, forums, and any community features.

Prohibited conduct includes:

  • Harassment, discrimination, or disrespectful behavior toward instructors or other participants
  • Sharing inappropriate, offensive, or irrelevant content in community spaces
  • Attempting to access other users' accounts or restricted areas of the platform
  • Using our platform to promote competing services or solicit other participants
  • Submitting false information or misrepresenting your identity
  • Interfering with platform functionality or other users' experience

We reserve the right to suspend or terminate access for users who violate these standards. Serious violations may result in immediate removal without refund. Most issues can be resolved through conversation – we'll reach out if concerns arise.

Submitted Content

When you submit work for review, participate in discussions, or share examples during sessions, you retain ownership of your content. However, you grant us a license to use submitted materials for educational purposes within the program, including as examples for other participants (anonymized when appropriate).

Don't submit confidential business information without clearance from your organization. We're not responsible for protecting proprietary information you choose to share, though we treat all participant submissions professionally.

4. Payment Terms and Refund Policy

Fees and Payment

Program fees are listed in Australian dollars on our website. Payment is due at enrollment unless you've arranged an alternative payment schedule. We accept major credit cards and bank transfers for business enrollments.

All fees are exclusive of GST, which will be added for Australian customers. International participants may be subject to additional taxes depending on their location – you're responsible for understanding your local tax obligations.

Cancellation and Refunds

Life happens. If you need to cancel enrollment, here's how refunds work:

  • More than 30 days before program start: Full refund minus 5% administration fee
  • 14-30 days before start: 75% refund
  • Less than 14 days before start: 50% refund
  • After program begins: No refund, but you may transfer enrollment to a future program within 12 months

If we cancel a program or can't deliver promised content, you'll receive a full refund or free transfer to the next available session. We'll provide at least 21 days notice for any program cancellations except in emergencies.

Price Changes

We won't change the price you paid after enrollment. However, program fees may increase for future intakes. Early registration often includes discounted pricing – watch for announcements.

5. Intellectual Property Rights

All course content, including videos, worksheets, frameworks, methodologies, and platform design, is owned by kilovareni or our licensors. This material is protected by Australian and international copyright laws.

The kilovareni name, logo, and branding are our trademarks. You may not use our branding without written permission, though you may reference your completion of our programs on resumes and professional profiles using factual descriptions.

Feedback and Suggestions

We love hearing how we can improve. When you provide feedback, suggestions, or ideas about our programs, you grant us the right to use and implement these suggestions without compensation or attribution. We appreciate your input and it genuinely shapes how we develop content.

6. Disclaimers and Limitations

Educational Nature

Our programs provide education about budget negotiation strategies and techniques. We share frameworks that have worked for professionals across various industries. However, every situation is unique – results depend on many factors including your specific circumstances, industry, experience level, and how you apply what you learn.

We don't guarantee: Specific outcomes, salary increases, improved negotiation results, or business success. These depend on factors outside our control. Our job is to teach proven techniques – your job is to adapt and apply them thoughtfully.

Professional Advice

Our content is educational, not personalized professional advice. We're not providing legal, financial, or career counseling specific to your situation. Before making significant decisions, consult with qualified professionals who understand your full context.

Platform Availability

We work hard to keep our platform running smoothly, but we can't guarantee uninterrupted access. Maintenance windows, technical issues, or factors beyond our control may occasionally affect availability. We'll communicate about planned maintenance and work quickly to resolve unexpected issues.

Our platform is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Liability Limitations

To the maximum extent permitted by Australian law, kilovareni's total liability for any claims related to our services is limited to the amount you paid for the specific program giving rise to the claim.

We're not liable for indirect, incidental, consequential, or special damages – including lost profits, lost data, or business interruption – even if we've been advised of the possibility of such damages.

Nothing in these terms limits liability for death, personal injury, fraud, or anything else that can't be limited under Australian law.

7. Privacy and Data Protection

We take your privacy seriously. Our separate Privacy Policy explains what information we collect, how we use it, and your rights regarding your personal data.

By using our services, you consent to data collection and use as described in the Privacy Policy. We comply with Australian Privacy Principles and applicable data protection laws.

  • We use industry-standard security measures to protect your data
  • You can request access to or deletion of your personal information subject to legal requirements

8. Third-Party Services and Links

9. Termination and Suspension

Your Right to Terminate

You may stop using our services anytime. For paid programs, cancellation follows the refund policy outlined in Section 4. After your program access period ends, your account transitions to limited access – you can view certificates and program completion records but not course materials.

Our Right to Terminate

We may suspend or terminate access if you violate these terms, engage in fraudulent activity, or behave in ways that harm other users or our platform. We'll usually provide warning and opportunity to correct issues before termination, except for serious violations requiring immediate action.

If we terminate your access for cause, you're not entitled to a refund. If we terminate without cause (which we'd only do in exceptional circumstances), you'll receive a prorated refund for unused program time.

10. Dispute Resolution

Most disagreements can be resolved through conversation. If concerns arise, contact us first – we're committed to finding fair solutions.

Informal Resolution

Before initiating formal proceedings, you agree to discuss the issue with us for at least 30 days. Send a written description of your concern to the address below. We'll work in good faith to reach a mutually acceptable resolution.

Governing Law

These terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia. Any disputes that can't be resolved informally will be subject to the exclusive jurisdiction of courts in the Australian Capital Territory.

Class Action Waiver

You agree to bring claims individually, not as part of a class action or representative proceeding. This doesn't prevent you from participating in mass settlement negotiations if applicable.

11. General Provisions

Entire Agreement

These terms, along with our Privacy Policy and any program-specific agreements, constitute the complete agreement between you and kilovareni regarding our services. They supersede any prior agreements or understandings.

Severability

If any provision of these terms is found unenforceable, the remaining provisions continue in full force. The unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

No Waiver

Our failure to enforce any right or provision doesn't constitute a waiver of that right. Waivers must be in writing to be effective.

Assignment

You may not transfer or assign your rights or obligations under these terms without our written consent. We may assign our rights and obligations to affiliates or in connection with a merger, acquisition, or sale of assets.

Force Majeure

Neither party is liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions. We'll communicate about such events and work to minimize disruption.
